During an interview this week, he touched on several areas of concern in which he urged people to seek professional legal advice to ensure their personal, financial and health are managed effectively.

“One area that affects us all is health care,” said the Founder of the Law Offices of Robert H. Brumfield in Bakersfield, CA. “Growing older means the potential of physical and mental health deteriorating, while assisted living or nursing home costs continue to rise.

“Without proper planning, a person’s financial nest egg could quickly evaporate on assisted living support instead of being utilized for more enjoyable things or being left to loved ones.”

There are numerous ways to protect assets and working options to pay for long-term care. “An Elder Law attorney can offer alternatives in which government programs such as Medicare and Medicaid can be utilized while limiting the impact and costs on assets.”

Mr Brumfield said they could also advise how a person may benefit from the Older Americans Act, which created the Administration on Aging, the agency advocating for older people.

The Act funds services and programs to benefit senior citizens and their families, and how they can be assisted by a wealth of government programs, from nutrition services to adult daycare and nursing home supervision.

“By creating an estate plan before they need it will give a person peace of mind in later life. They will also be able to review and modify wills and trusts as circumstances change,” asserted Mr Brumfield.

An experienced attorney can also offer advice on a structure if a person’s health deteriorates and they become incapacitated.

He added: “There are options that can kick in to reflect a person’s wishes if there comes a time when they can no longer manage their estate and financial affairs independently. These include executors and decision-makers being appointed or loved ones seeking legal guardianship, if necessary.”
