When a person dies, someone usually has to pick up the threads of their estate and work through the complexities of who gets what and when. The Founder of the Law Offices of Vlad Portnoy, P.C, based in New York, NY, took time out from his busy schedule to explain what a probate lawyer does and the role they can play in ensuring that probate comes to a successful and seamless conclusion.

When someone passes away, their assets must be distributed to beneficiaries, after any claims against their estate, in terms of debts and taxes, are settled". The directions are usually outlined in a person’s will and the process is known as probate.

Mr. Portnoy said a probate lawyer is a state-licensed attorney who works with the executor and beneficiaries of an estate to settle the person’s affairs. A probate lawyer – otherwise referenced as an estate attorney – can be the appointed executor or guide an executor through the probate process in line with state law.

“Depending on the complexities and value of an estate, a probate lawyer can be involved in many different ways,” he said.

Some of the tasks a probate lawyer may assist with or complete in the process include identifying and securing estate assets and assisting in settling and validating debts and bills. They also extend to filing forms and documents needed by a probate (surrogate) court, assessing any tax dues on the estate, and settling them.

Mr. Portnoy said an attorney could also be tasked with collecting funds from checking, savings and investment accounts and in addition obtaining value appraisals for any real estate or business ownership interests left by the decedent.

He advised that a probate attorney handles the probate process after a person dies, while an estate planning attorney works with clients to draft their wills, and trusts, and overall provide planning for their estates. A probate attorney can also provide services as an estate planning attorney.

When there is a challenge to a will from a beneficiary, a probate lawyer can offer representation to a party in probate litigation.

Mr. Portnoy said that while probate lawyers are either paid by a flat rate, by the hour, or as a percentage of the estate's value, the exact arrangement will depend on an attorney’s experience and the legalities needed to be addressed.

For those seeking to retain a probate lawyer, he concluded that they must ask a number of questions before doing so. These could include their experience and areas of concentration, what services they provide, their charges, and to discover the extent of the process involved.
