New York Estate Probate Lawyer Natalia Sishodia Explains the NY Estate Probate Process

New York estate probate lawyer Natalia Sishodia (https://sishodia.com/new-york-estate-probate-lawyer/) releases a new article explaining the NY estate probate process. The lawyer mentions that the probate process refers to the transfer of property from a person to their heirs. Going through the probate process can be lengthy and complicated, especially after losing a loved one.

“A Will or a Last Will and Testament is a written document detailing what a person wants to be done with their property after they have passed away. A person who has written and executed a Last Will and Testament is referred to as a testator,” the New York estate probate lawyer says.

New York estate probate lawyer Natalia Sishodia adds that a lawyer may be able to provide advice on where a person may keep their Will. Some New York counties also have a vault in their Surrogate’s Court where residents may be able to keep their copies safely. Wills should be treated as confidential documents until the person passes away and only become a matter of public record when filed in probate.

In a Will, there are directives on property division, donating properties to charity, and guardianship of any minor children. The executor or fiduciary will be the one responsible for carrying out the decedent’s wishes. Wills are very important documents that must be kept in a safe place.

In the article, the lawyer adds, “Wills do not take effect automatically. When a person dies, there are specific legal processes involved to determine whether the document is authentic and whether it has been created in accordance with the law. If a person leaves behind a Will, the document should be filed by the decedent’s representative with the Surrogate’s Court to be admitted for probate.”

Lastly, the lawyer emphasizes that it is important to seek the help of a skilled probate attorney when it comes to matters involving the probate process. An experienced probate attorney may be able to help the client set up their wealth for the future in case the client passes away.
